A St. Catharines trucker has lost an appeal of the provincial rule that prevents big rigs from going faster than 105 km/h.
Gene Michaud successfully argued in a Welland court in 2012 that the law forcing truckers to use speed limiters, set at no more than 105 km/h, was unsafe and violated his charter rights.
This after he was charged for having his rig's speed limiter set at 109 km/h.
But the province appealed and the decision was overturned two years later.
Michaud passed away in 2013, but his widow and the organization representing independent truckers decided to take the case to the court of appeal.
The court ruling this week that speed limiters improve road safety and also reduce greenhouse gas emissions.
